The project explores the legal and economic challenges posed by the ecological transition by aiming at :

  • rethink the allocation of responsibilities in a context of systemic uncertainty,
  • develop innovative methods for assessing environmental damage,
  • propose new risk allocation mechanisms compatible with the requirements of the transition.

The thesis project tackles two major challenges of ecological transition: assigning individual responsibility in a context of systemic uncertainty and accurately assessing environmental damage. At the crossroads of international law, environmental law, and transition economics, it aims to adapt causality criteria to the specificities of climate change and improve methods for assessing ecological damage. Using a transdisciplinary approach, the project will analyze the interdependence between legal norms, economic dynamics, and environmental issues. It will also develop new risk allocation mechanisms compatible with evolving public policies. In partnership with the IISD, we will work to co-produce amicus curiae briefs for strategic litigation, propose model clauses for treaties and contracts, and actively participate in discussions on the reform of investor-state dispute settlement.
